KEY WEST MARRIAGE LICENSES
To
secure a marriage license from the county court house in Key
West, go to 500 Whitehead Street (Monday through Friday - 8:30
to 5:00), the Lester Building 305-292-3458. Wherever you are
staying, the courthouse is nearby because we are on a very
small island.
No medical tests are
required.
Anyone 18 or older can get married.
There is no waiting period if both parties are out of state
residents.
If you are Florida residents, you may obtain a license at your
local county clerk's office, as well as here in Key West.
There is a 3-day waiting period for Florida State residents.
The license cost is $93.50 and is valid for 60 days from the
effective date. Payment can be made in personal check, cash,
cashier's check, or money order. No credit cards accepted.
Make sure you have valid photo identification when going for
your marriage license (passport, driver's license, etc.,
military ID, alien registration card)
If either party has previously been married, please bring a
copy of the divorce decree at the time of application if
divorce is within the last six months. If longer than six
months, the exact date of divorce is required.
If a death was involved, the exact date of death is also
required. If within the last six months, the court requires a
copy of the death certificate. |

DOMESTIC PARTNER REGISTRATION
The City of Key West will register domestic partnerships
for gay and lesbian couples. To register your domestic
partnership you must appear in person at the City Clerk's
office, which is located in Key West City Hall at 525 Angela
Street in Key West. The cost for registering a domestic
partnership is $50.00. |

Domestic
Partnership Info
Domestic Partners are two adults who have chosen to share one
another’s lives in a family relationship. Two persons are
considered to be Domestic Partners if:
1. They consider themselves to be members of each other’s
immediate family
2. They agree to be jointly responsible for each other’s basic
living expenses
3. Neither of them is married or a member of another Domestic
Partnership
4. They are not blood related in a way that would prevent them
from being married
5. Each is at least of the legal age and competency required
by Florida Law to enter into a marriage or other binding
contract
6. They have signed a Declaration of Domestic Partnership
To establish a Domestic
Partnership two people shall sign a Declaration of Domestic
Partnership in the presence of the City Clerk. As further
evidence of Domestic Partnership two of the following
documents must be presented along with the Declaration of
Domestic Partnership:
1. A lease, deed or mortgage indicating that both parties are
jointly responsible
2. Driver’s licenses for both partners showing the same
address
3. Passports for both partners showing same address
4. Other documents that in the opinion of the City Clerk
conclusively demonstrates the applicants are living together
as a family, including but not limited to, credit cards with
the same account numbers in both names, wills, powers of
attorney, or a joint title ownership of a vehicle.
A Domestic Partnership is
terminated when:
1. One of the partners dies
2. A Domestic Partner files a termination statement with the
City Clerk, by hand or certified mail, for any reason
The fee for filing a Declaration of Domestic Partnership is
$50.00. It is suggested you call the City Clerk’s Office at
305-292-8193 for an appointment.
